Please read these Terms of Service ("Terms") carefully before using the Charity Bribes website, mobile application (including our iOS app), or any of our services (collectively, the "Services").
1. Acceptance of Terms
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.
2. Eligibility
To use our Services, you must be at least 13 years old. By accessing or using our Services, you represent and warrant that you meet this age requirement. If you are under 13, please do not access or use our Services.
3. Account Registration
To access certain features of our Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized use of your account or any breach of security.
4. Content and User Submissions
Our Services allow you to submit suggestions for future bribes, upvote or downvote other users' suggestions, and interact with public profiles. By submitting any content ("User Content") to our Services, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with our Services and our business, including without limitation for promoting and redistributing part or all of our Services (and derivative works thereof) in any media formats and through any media channels.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant the license described above.
5. Prohibited Conduct
You agree not to engage in any of the following activities while using our Services:
• Submitting false or misleading information.
• Violating any applicable laws or regulations.
• Harassing, threatening, or defaming any person or entity.
• Submitting content that is obscene, offensive, or inappropriate.
• Interfering with the operation of our Services or any user's enjoyment of our Services.
• Attempting to gain unauthorized access to our Services or any user's account.
We reserve the right to remove any User Content and suspend or terminate your account at our sole discretion if we believe you have violated these Terms.
6. Bribes/Pledges/Donations and Refunds
When you make a donation through our Services, your payment will be processed by our third-party payment processor, such as Benevity or Apple Pay. We are not responsible for the processing of your payment or the handling of your personal information by these third-party processors.
If a bribe is unsuccessful, we may, at our sole discretion, process a refund for your donation. Refund requests must be submitted in accordance with our refund policy, which is available on our website or mobile application.
All bribe pledges are subject to the completion of the bribe challenge by the public figure or celebrity within the allotted time. If the challenge is not completed, the pledged amount will be refunded to the pledger, as mentioned above. However, if the public figure or celebrity decides to match the total amount raised and not perform the bribe challenge, Charity Bribes has the right to release the bribe pledges to the indicated charity.
7. Intellectual Property
All content included in our Services, such as text, graphics, logos, images, and software, is the property of Charity Bribes or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our Services without our express written permission.
8. Disclaimers and Limitations of Liability
Our Services are provided "as is" and "as available" without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
In no event shall Charity Bribes, its affiliates, or their respective officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or other intangible losses, arising out of or in connection with your use of our Services, even if Charity Bribes has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations in this section may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless Charity Bribes, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of our Services or your violation of these Terms.
10. Changes to the Terms of Service
We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website or mobile application and updating the "Last updated" date at the top. You are advised to review these Terms periodically for any changes. Your continued use of our Services after the posting of any changes constitutes acceptance of those changes.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Canada for the resolution of any disputes arising out of or relating to these Terms or your use of our Services.
12. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, the parties agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms shall remain in full force and effect.
13. Fees and Payment
Charity Bribes charges a 5% fee for operating costs and platform development on all bribe pledges made through the platform. This fee is deducted from the total amount pledged, including in cases where the bribe is not successful and refunds are issued. In the event of a refund, the 5% fee will be deducted from the refunded amount.
